Complete Terms and Rules of Membership for www.graphicsgoldclub.com
It is the responsibility of all prospective members of www.graphicsgoldclub.com to read and understand the following terms and rules of membership prior to joining. If you purchase a membership, you agree to these terms and rules. It is also the responsibility for all members
to abide by the following terms and rules of membership in www.graphicsgoldclub.com.
General Terms of Operation
We reserve the right to shut down or suspend operations of www.graphicsgoldclub, or modify the site at any time, without prior notice.
Membership Levels and Your Benefits
Each membership level gives you the following benefits :
Bronze Membership Level
1. You get full access to and may download, the new graphics package I create every month. Personal use only. You may use these graphics on your own site and sales pages.
You may not sell or give away these graphics.
2. Access to all past monthly graphics packages, which you may download and use in your own business, on your own websites and sales pages, ect. They are for your own personal use only and
you may not sell or give these graphics away. Violation of these terms will result in forfeiture of your membership.
3. Access to the Bronze Level Bonus Vault and all products within. The Bronze Level Bonus Vault will carry mostly products for your personal use only, and is a limited version of the full bonus vault found in the Silver and Gold membership levels.
4. Full access to the Resources section, which will contain graphic tools you can download and use, links to online resources and more.
Silver Membership Level
1. You get full access to and may download, the new graphics package I create every month. You may use these graphics on your own site and sales pages, ect., and in your own business.
You are granted the right to sell these monthly graphics packages to your own customers, but you may not pass on the resell rights to others.
If you sell the package, You may not modify the graphics in any way, nor put your own name on the package, however, you may personalize the salesetter with your own name. Full rights terms will be stated in a YOUR_RIGHTS.txt file included in the product. You also may not include the product in any membership site, free or paid, nor may you give the product away, for any reason.
2. Access to all past monthly graphics packages, which you may download and use in your own business, on your own websites and sales pages, ect. Other terms are the same as item #1 above.
3. Access to the Full Bonus Vault and all products within. The Bonus Vault will carry graphics, and other products for your personal use and for resale, and each product will have it's own license terms which you are required to abide by. Please see the individual license terms to find out what you are allowed to do with the products.
4. Full access to the Resources section, which will contain graphic tools you can download and use, links to online resources and more.
Gold Membership Level
1. You get full access to and may download, the new graphics package I create every month. You may use these graphics on your own site and sales pages, ect., and in your own business.
You are also granted the Private Label Rights to the monthly graphics packages and may modify the product in any way you choose, according to the PLR license terms. Full rights terms will be stated in a YOUR_RIGHTS.txt file included in the product.
You may not, however, include the monthly graphic product in any membership site, free or paid, nor may you give the product away, for any reason,
unless you modify the product substantially, so that the product may not be recognizable as the original product. It must also be renamed. In other words, in order to include the product in any membership site, or to give the product away for any reason, you must create a completely new product out of the original product. Simply changing colors, renaming it and putting your name on it does not qualify as a "new product".
Violation of these terms will result in the termination of your membership, revoking of your PLR license to any products you possess from www.graphicsgoldclub.com, and permanent ban from rejoining the membership.
2. Access to all past monthly graphics packages, which you may download and use in your own business, on your own websites and sales pages, ect. Other terms are the same as item #1 above.

Reselling of www.graphicsgoldclub.com products
1. Your rights concerning the reselling of products offered in the www.graphicsgoldclub.com membership are generally spelled out above, under "Membership Levels and Your Benefits". However,
there are exclusions. No product offered by and found in the www.graphicsgoldclub.com membership site may be added to any other membership site, unless the product specifically grants such rights.
The monthly graphics package provided to the membership may not be added to any other membership site, free or paid, without express approval from me, Craig Kaiser, the owner and operator of www.graphicsgoldclub.com, and sole designer of the monthly graphics package.
The reasoning behind this is simple. My goal for the Graphics Gold Club is to become a prime source for new, fresh, professionally designed graphics products to my Bronze Level members, as well as Silver and Gold Level members, and
to allow my Silver and Gold Level members to become the "Prime Source" for these graphics to their customers.
If these products are allowed to be included in other membership sites, soon, thousands of people would have access to these products not from this source, nor from my Silver and Gold Level members, but from other membership sites. This would have a "chilling" effect on the site and may greatly affect membership enrollments. If people could get
these products elsewhere without paying any more extra for them, such as in membership sites, then they would not have the incentive to join this site, nor purchase from the Silver and Gold members.
2. Reselling any other product from www.graphicsgoldclub.com will be governed by the level of membership and it's corresponding benefits, as well as individual resell license terms provided by the product. Individual Resell
license terms provided by the product will supersede the member level restrictions. In other words, if you are a Silver member, even though your rights as a Silver member restricts you to basic resell rights only for the monthly product, if another product carries a master resell rights license,
that license will overrule your membership level restrictions and you may sell the product according to the license.
To make it simpler, all products will have a clearly spelled out license file supplied with it. Just follow product's license file for your selling rights to the product.
Copyrights
I, Craig Kaiser, retain the sole copyright of all products created by me and offered through www.graphicsgoldclub.com. The PLR license granted to Gold Level Members does not pass on the copyrights to the graphics products to said members. I retain the copyright, except for the instance where a Gold Level member creates a new product out of the original product that
legally qualifies as a "derivative work" according to U.S. copyright law. In such a case, the Gold Level member would claim copyright to
the new, "derivative work", according to U.S. copyright law, however, I would still retain copyright to the original work.
Terms of membership and cancelation of memberships
Membership to the www.graphicsgoldclub.com membership site, aka the Graphics Gold Club, is on a monthly term basis, unless a prepaid term is offered, such as 6 months or 12 month terms.
Members are automatically billed each month through PayPal. Members can cancel their membership at any time, simply by accessing their PayPal account, going to their
"subscriptions" in the account history and canceling their subscription.
Members are responsible for making sure they have sufficient funds available for membership payment at the time of their billing. If a member's payment fails, the member will be temporarily suspended and contacted. If the
situation is corrected, the member will be unsuspended, and reinstated to full membership.
Upgrading Your Membership Level If you join, and later decide you wish to upgrade to the next level, DO NOT cancel your membership. Instead, contact me through the help desk and provide your account details and I will provide you with a payment link for the level
you wish to upgrade to. I'll then instruct you to cancel your previous membership in your Paypal account, and I will transfer your account over to the new level account.
This must be done manually.
If a member chooses to cancel their membership, said member may not rejoin for a period of 6 months from the date of membership cancelation. If a member's membership is cancelled by www.graphicsgoldclub.com, the same terms apply.
www.graphicsgoldclub.com reserves the right to permantly ban members for actions considered harmful to the site, or to the membership, at www.graphicsgoldclub.com's sole discretion.
Members who have canceled their memberships or have had their membership revoked, may rejoin after a period of 6 months from the date of the cancelation of the membership, subject to the following :
1. Former member must request to rejoin by submitting the request to our help desk. Conditions of the members' original cancelation will be reviewed. If the original cancelation was initiated by www.graphicsgoldclub.com, the
request to rejoin may be denied if the original termination of membership was the response to actions deemed harmful to the www.graphicsgoldclub.com website or membership.
If the rejoin request is approved, the member will be contacted and provided a rejoin payment link.
2. Rejoining members must pay an upfront lump sum payment equal to 6 months of membership dues for the level they wish to rejoin. Regular monthly payments will begin the second month of the membership.
3. Membership openings must be available for the level member wishes to rejoin at. This is a closed membership, except for the Bronze Level. If there are no membership openings, the former member will be notified a put on a waiting list, after the request has been reviewed.
Account Sharing and Passwords
You are prohibited from sharing account details and/or passwords in any manner to anyone, for any reason without prior, explicit approval from me, Craig Kaiser, owner and operator of www.graphicsgoldclub.com. Violation will result in your account termination and permanent ban from the site.
Your IP address is recorded upon account registration and kept on file.
These are the current Complete Terms and Rules of Membership for www.graphicsgoldclub.com, and are subject to change.
www.graphicsgoldclub.com reserves the right to modify these terms at anytime, without notice.
By joining www.graphicsgoldclub.com you are indicating you agree with these terms and will abide by them during your term of membership.
